AND THE ANNA MUNICIPAL COMPLEX COUNCIL CHAMBERS, LOCATED AT 120 WEST 7TH STREET, TO CONSIDER THE FOLLOWING ITEMS. AND THANK YOU FOR STAYING LATE, TOO. AND I SENT OUT AN EMAIL TO THE COUNCIL AND TO MARK, IN REGARDS TO THE JPI APARTMENTS IN ANNA TOWN SQUARE, BECAUSE TINY BIT OF HISTORY IN THREE MINUTES THE PREVIOUS OWNERS HAD ACQUIESCED TO SOME CONCESSIONS.

ONE OF THEM WAS A TEN FOOT SETBACK. ANOTHER ONE WAS A PULL IN DRIVE, AND THEN A THIRD ONE WAS NO BALCONIES ON THE OUTSIDE PERIMETER OF THE COMPLEX. SO THEY'VE DONE THE TEN FOOT SETBACK.

THEY'VE DONE THE PULL IN DRIVE. BUT IF YOU TAKE A TAKE A LOOK AT THE APARTMENTS, THEY HAVE BUILT BALCONIES FACING THE RESIDENTS ON SHARP AND THEN ALSO ON FINLEY. SO I WANTED TO BE SURE AND BRING THAT TO Y'ALL'S ATTENTION.

THE APARTMENTS ARE STILL UNDER CONSTRUCTION, AND IT'S NEVER TOO LATE TO REMOVE A BALCONY ANYWAY.

BUT THE OTHER THING IS ON LEONARD. SO, I DON'T KNOW, MAYBE THIS IS A REGULAR THING, BUT I NOTICED THERE'S A NEW DEVELOPMENT GOING IN, AND THEY'VE THEY'RE PUTTING UP THE PERIMETER.

AND THE PERIMETER OF THIS DEVELOPMENT IS A WOODEN FENCE, AND I HADN'T REALLY LOOKED, BUT I GUESS I THOUGHT THAT A PERIMETER OF A DEVELOPMENT WAS USUALLY BRICK. SO THEN I WENT TO MCKINNEY TO THE MOVIES, LOOKED AROUND.

THAT'S NOT TRUE. BUT WHAT I DID NOTICE WAS THE BRICK PERIMETERS LOOK A WHOLE LOT NICER THAN A WOODEN PERIMETER.

SO THAT WAS MY SECOND EMAIL TO THE COUNCIL AND TO MARK.

AND THEN LASTLY I'VE SPOKEN BEFORE ON APARTMENTS DONE WITH APARTMENTS.

THE FIRST OF WHICH IS OUR DEPARTMENT WILL BE MOVING TO THE ALTERNATE SHIFT SCHEDULE, THE 48/96, IN ABOUT SIX DAYS. SO IT'LL BE JANUARY 19TH. AND JUST KEEPING KEEPING IN MIND MY PRESENTATION A COUPLE OF MONTHS AGO ABOUT THAT STAFFING RATIO.

AND ALSO HELPED US CONVERT OUR CONFERENCE ROOM INTO THE OFFICIAL FIRE MARSHAL'S OFFICE.

SO WE ACTUALLY HAVE A FIRE MARSHAL'S OFFICE NOW, NOT JUST AN AREA THAT WE CAN ALL GATHER AROUND AND TALK.

FARMS PUBLIC IMPROVEMENT DISTRICT AREA 1 PROJECT.

PUBLIC WORKS DIRECTOR, MR. COTTON. ALRIGHTY THANK YOU.

HI. GOOD EVENING. MAYOR, COUNCIL. ANDRE AYALA WITH HILLTOP SECURITIES.

THIS EVENING I'M HERE TO TALK ABOUT THE SHERLEY FARMS PUBLIC IMPROVEMENT DISTRICT.

YOU MAY RECALL THAT I DON'T KNOW IF THIS IS UP.

ALL RIGHT PRIMARILY A RESIDENTIAL DEVELOPMENT, THAT WAS ANNEXED INTO THE CITY OF ANNA IN MARCH OF LAST YEAR.

THE CITY CREATED A PUBLIC IMPROVEMENT DISTRICT CALLED THE SHERLEY FARMS PUBLIC IMPROVEMENT DISTRICT.

PURSUANT TO THAT AGREEMENT THAT THE CITY EXECUTED BACK IN DECEMBER OF 2024.

SUCH AGREEMENT INCLUDES THE CITY FACILITATING THE FINANCING OF CERTAIN PUBLIC IMPROVEMENTS WITH SPECIAL ASSESSMENTS AND THE ISSUANCE OF BONDS TO FINANCE THOSE SPECIAL ASSESSMENTS.

AND THAT IS WHAT I'M DISCUSSING TONIGHT. SO WHAT WE HAVE HERE IS WHAT WE CALL IMPROVEMENT AREA 1, WHICH IS THE FIRST PHASE OF THE PROJECT. THE DEVELOPER HAS INDICATED THAT THEY ARE ASKING THE CITY TO FINANCE 418 LOTS.

AND THOSE ARE A VARIETY OF 45S TO 70S. THE AVERAGE EXPECTED HOME PRICE FOR THIS PARTICULAR PHASE IS ABOUT $573,000.

THAT GENERATES ABOUT $1.2 MILLION IN PROPERTY TAX REVENUE FOR THE CITY.

HOWEVER, IN THAT AGREEMENT, THE CITY AGREED TO PARTICIPATE AT 50% OF ITS TAX RATE TO INCENTIVIZE THESE PEOPLE TO COME INTO ANNA.

SO THE NET AMOUNT OF PROPERTY TAXES THAT ARE EXPECTED TO BE GENERATED JUST BY IMPROVEMENT AREA 1 ONLY, NOT THE ENTIRETY OF THE PROJECT, JUST THAT PARTICULAR PHASE IS ABOUT $630,000 PER YEAR.

AND IN THE IN THE SCREEN YOU HAVE, YOU KNOW, THE COMPOSITION OF WHAT IMPROVEMENT AREA 1 IS, AGAIN, FOR 118 LOTS, A VARIETY OF 45S AND 70S, THE LOW PRICE POINT'S $477,000.

THE HIGHEST ONE IS $742,000. FOR THIS PARTICULAR PROJECT WE RAN THE NUMBERS AND AS PART OF THE CITY'S OBLIGATIONS, IS TO PUT TOGETHER THE ISSUANCE OF BONDS AND THE LEVY OF ASSESSMENTS.

OUR JOB AS YOUR FINANCIAL ADVISOR IS TO MAKE SURE THAT WHATEVER YOU DO IS WITHIN THE CONFINES OF THAT AGREEMENT.

SO WHEN WE PUT TOGETHER THE NUMBERS, WE DERIVED AN APPROXIMATE $33,950,000 ASSESSMENT, WHICH WOULD BE A BOND FOR IMPROVEMENT AREA 1, ONLY. THAT BOND COUNCIL, JUST LIKE ANY OTHER BONDS THAT YOU HAVE ENTERTAINED BEFORE, WOULD BE ONLY SECURED BY SPECIAL ASSESSMENTS LEVIED WITHIN IMPROVEMENT AREA 1 OF THAT PARTICULAR PIN, NOTHING ELSE. SO THE CITY'S TAX RATE, ENTERPRISE FUNDS OR OTHER REVENUES THAT THE CITY TAKES IN DO NOT SECURE THE BONDS.

AND THE BOND HOLDERS UNDERSTAND THAT IS THE CASE.

THE ONLY THING SECURING THIS BOND IS SPECIAL ASSESSMENTS LEVIED AND COLLECTED WITHIN IMPROVEMENT AREA 1.

NOW WE DO HAVE THAT TAX INCREMENT ZONE PARTICIPATION HERE THAT BECOMES A CREDIT ON THE ASSESSMENT.

SO WHENEVER THAT VALUE COMES IN YOU CREDIT THE ASSESSMENT DOWN.

SO THE PROPERTY OWNERS PAY A LITTLE BIT LESS THAN WHAT THE FACE VALUE OF THE ASSESSMENT WOULD BE. WE PUT TOGETHER OUR SOURCES AND USES OF FUNDS AND THESE ARE APPROXIMATE NUMBERS RIGHT NOW. COUNCIL THIS NUMBER MAY MOVE. AND IF IT DOES IT'S PROBABLY GOING TO MOVE DOWN, NOT UP.

BUT THIS IS JUST AN APPROXIMATION. SO IT'S $33,150,000.

AND THE AUTHORIZED IMPROVEMENTS THAT WE CURRENTLY HAVE IN THE REPORTS FROM ENGINEERING AND ASSESSMENT CONSULTANTS ARE ABOUT $27.4 MILLION OF PUBLIC IMPROVEMENTS TO BE FINANCED VIA THE SPECIAL ASSESSMENTS AND ISSUANCE OF BONDS FOR THIS PROJECT.

IN ADDITION TO THAT, WE HAVE OTHER CATEGORIES. YOU'VE SEEN THESE BEFORE, SO WE HAVE AN ALLOCATION OF THE BOND PROCEEDS TO TAKE CARE OF THE INTEREST ACCRUAL BETWEEN NOW AND THE END OF THIS FISCAL YEAR, BECAUSE WE KNOW WE DIDN'T LEVY ASSESSMENTS THIS FISCAL YEAR. WE HAVE A RESERVE THAT COVERS THE BONDS.

THAT'S ONE YEAR'S WORTH OF PAYMENTS. WE HAVE THE FINANCING COST, WHICH INCLUDES BOND UNDERWRITING, LEGAL FEES, ALL THE FEES INCLUDED IN THERE. AND THEN WE HAVE A SMALL ALLOCATION FOR ADMINISTRATIVE FUND BECAUSE WE DON'T WANT THE CITY TO SUBSIDIZE ANYTHING. SO WE TAKE A PORTION OF THE BONDS, PUT IT IN AN ADMINISTRATIVE ACCOUNT TO COVER THE COSTS FOR TWO YEARS.

SO IT'S USUALLY ABOUT $40,000. WE'RE PUTTING TWO YEARS OF ADMINISTRATIVE EXPENSES OUT OF THE BOND PROCEEDS IN THERE.

SO STATISTICS THAT WE PUT TOGETHER HERE, COUNCIL IS A 30 YEAR BOND JUST AS PER YOUR AGREEMENT.

SO THE FINAL MATURITY OF THIS BOND IS EXPECTED TO BE IN SEPTEMBER OF 2056.

WE ARE RUNNING THIS NUMBERS AT 6%. SO THE MARKET HAS BEEN MOVING RECENTLY.

WHEN WE PUT TOGETHER THESE NUMBERS, THE MARKET WAS A LITTLE BIT HIGHER. SO IF WE WERE TO PRICE TODAY WE COULD PROBABLY SEE AN INTEREST RATE UNDER 6%.

BUT AGAIN OUR BUDGET IS 6% FOR NOW, WE HAVE A DEBT TO VALUE RATIO.

I'M SORRY, A VALUE TO DEBT RATIO OF 1.75 TIMES, WHICH IS WHICH IS THE COVERAGE OF THE OF THE VALUE OF THE PROJECT AGAINST THE DEBT FOR 118 LOTS. AS I MENTIONED, THAT'S AN AVERAGE LIEN OF ABOUT $81,000.

WE HAVE AN AVERAGE TAX RATE ASSESSMENT OF ABOUT 1.10% THAT THE CEILING IN YOUR AGREEMENT IS 1.35%.

SO WE'RE WELL UNDER THAT. WE HAVE A PARTICIPATION FROM THE CITY WHENEVER THAT VALUE COMES IN.

AND THAT IS ON A PARCEL BY PARCEL BASIS SO THAT WE DON'T HAVE ONE PARCEL SUBSIDIZING ANOTHER.

SO THAT WOULD BRING DOWN THE NET ASSESSMENT ABOUT 84 PENNIES ON AVERAGE.

BECAUSE THESE ARE MORE HIGH VALUE HOMES, IT'S ABOUT $4,800 PER YEAR.

AND THE FIRST PAYMENT WOULD BE DUE IN JANUARY OF THE FOLLOWING YEAR.

BECAUSE AGAIN THIS YEAR WE DIDN'T LEVY ASSESSMENTS. SO YOU WOULD BE ASKED TO DO THAT IN THE SUMMER OF 26 FOR COLLECTIONS IN JANUARY OF 2027.

AND AGAIN, THESE ARE JUST PRELIMINARY STATISTICS SUBJECT TO CHANGE. THIS IS WHAT WE HAVE BUDGETED FOR NOW. AS FAR AS TIMELINE COUNCIL, THIS IS JUST AGAIN A PRESENTATION FOR YOU TO ASK ANY QUESTIONS REGARDING THE UPCOMING LEVY OF ASSESSMENTS AND ISSUANCE OF BONDS.

SO INITIALLY WE WE HAD THIS. THIS TIMELINE THAT IS GOING TO SHIFT BY TWO WEEKS.

WE HAVE SOME TECHNICAL ISSUES THAT WE HAVE TO FIX IN THE ASSESSMENT PLAN BASED ON ENGINEERING INPUT AND APPRAISALS AND WHATNOT.

SO WHAT YOU SEE HERE IS GOING TO BE SHIFTED BY TWO WEEKS.

SO THE JANUARY 27TH ITEM IS NOW GOING TO BE FEBRUARY 10TH.

THE FEBRUARY 10TH ITEM, WHICH IS WHEN YOU WOULD BE ASKED TO HAVE A PUBLIC HEARING, CONSIDER THE LEVY OF ASSESSMENTS AND THE ISSUANCE OF BONDS THAT MOVES TO FEBRUARY 24TH AND THEN THE CLOSING, BECAUSE WE'RE NOW ISSUING LATE IN FEBRUARY, WE'RE PROBABLY GOING TO DO IT TOWARDS MID TO LATE MARCH.

AND WE'LL ASK THE ATTORNEYS TO GUIDE US ON WHAT THE APPROPRIATE CLOSING DATE SHOULD BE FOR THAT. WITH THAT COUNCIL, I'LL ENTERTAIN ANY QUESTIONS YOU MAY HAVE REGARDING THIS PRELIMINARY PLAN OF FINANCE FOR SHERLEY FARMS. ALL RIGHT. COUNCIL, ANY QUESTIONS OR COMMENTS? YOU'RE TALKING ABOUT THE VALUES OF THE HOMES? YEAH. THE VALUES, AS WELL AS THE. AS WELL AS THAT 12.

THAT $1.2 MILLION, IN RELATION TO THIS TYPE OF PRODUCT.

SO I'LL TAKE THE FIRST QUESTION. I THINK THAT THIS ONE WOULD BE ABOVE AVERAGE. OKAY BONDED. SO THAT WOULD BE THE ANSWER TO THAT ONE.

AS FAR AS YOU KNOW, JUST LOOKING AT THIS CHART, THE PARTICIPATION, THAT IS SOMETHING THAT HAS BECOME RATHER COMMON FOR CITIES TO INCENTIVIZE OTHER PEOPLE TO COME INTO THE CITY.

SURE DO WE WANT TO PARTNER WITH THESE DEVELOPERS SO THEY DEVELOP IN THE CITY VERSUS OUTSIDE OF THE CITY? WHAT DOES IT TAKE FOR THEM TO DO THAT? IN THIS PARTICULAR CASE IT IS A 50%.

THAT IS NOT UNCOMMON AT ALL. OKAY. THAT WOULD BE SOMETHING THAT IS WITHIN RANGE.

GLAD TO HEAR IT. THANKS. AND DID I ANSWER ALL YOUR QUESTIONS? A COUPLE QUESTIONS HERE. SO FIRST OBSERVATION SO THE AVERAGE SALES PRICE IN ANNA IS ABOUT $360K.

SO I DO APPRECIATE THIS. THIS DOES HELP LIFT UP THE OVERALL SALES PRICE IN ANNA AS WELL.

IT'S A GOOD STEPPING STONE TO SOME BIGGER LOTS.

I DO HAVE A QUESTION THOUGH. SO FROM MY UNDERSTANDING THIS IS WORKING OUT TO ABOUT $400 A MONTH FOR PID COSTS THAT WILL BE ADDITIONAL FOR EVERY HOUSE THERE.

SO WHAT WE HAVE HERE, COUNCILMAN IS SORRY, THE OTHER WAY.

WE HAVE AN EXPECTED AVERAGE PAYMENT OF ABOUT $4,800 PER YEAR.
