AS YOU KNOW, I'VE BEEN TRYING TO ATTRACT LARGE WIDE ACREAGE INVESTORS.

THIS IS BECAUSE OF LIMITED TIME AND COLD CALLING.

THEY'RE NOT THAT HAPPY TO RETURN COLD CALLS.

I'M NOT GIVING UP, BUT I'VE COME HERE TO ASK FOR YOUR HELP.

BUT FIRST, I WANT TO TELL YOU ABOUT SOMETHING I DID FIND.

SIX MILES FROM THIS CITY HALL, ON 19 ACRES UNB INVESTMENTS, LLC IS DEVELOPING CATTLEMEN'S CROSSING.

THEIR LOTS ARE AT LEAST A FOURTH TO A FIFTH OF AN ACRE.

THIS IS IN MELISSA JUST SOUTH OF THROCKMORTON, EAST OF FIVE.

I GUARANTEE YOU, THEY'RE NOT DEVELOPING THAT FOR CHARITY.

THEY'RE GOING TO MAKE MONEY.

I HAVE A CALL INTO THEM.

IT'S THOSE KINDS OF INVESTORS WE NEED TO ATTRACT TO THIS CITY, WHICH TAKES ME TO MY NEXT POINT.

FIRST FULL DISCLOSURE, I NOW OWN 12 SHARES IN TRI POINTE HOMES, I E OAKRIDGE DEVELOPMENT.

I DID THAT BECAUSE I WANTED TO LOOK AT THEIR FINANCIALS.

I GUARANTEE YOU EVEN THOUGH I'M AN UNEDUCATED PERSON, THEY'RE DOING WELL.

MY POINT IS THIS. TRI POINTE HOMES COULD AFFORD TO CONSIDER LARGE LOTS AND HOMES ON ACREAGE AS A VERTICAL MOVE IN THEIR MANAGEMENT COMPANY.

MR. FRENCH HAS BEEN VERY NICE AND OPEN TO TALK TO US, BUT I SEE NO REASON IN THE FINANCIALS WHY THEIR FINANCIAL SERVICES DIVISION OF TRI POINTE HOMES CAN'T MAKE A VERTICAL MOVE INTO SOMETHING OTHER THAN THEIR REGULAR SMALL LOT HOMES.

NEXT, I ASKED THE CITY COUNCIL, THE CITY MANAGEMENT, THE CITY STAFF, TO BE PROACTIVE IN TRYING TO ATTRACT LARGE LOT ACREAGE.

WE'VE DONE EVERYTHING WELL, TO GET A TAX BASE WITH MULTIFAMILY APARTMENTS.

YOU ALL KNOW THE DRILL.

WE'VE GOT ENOUGH OF THOSE.

WE NEED FOR ECONOMIC STABILITY LARGE LOTS AND HOMES ON ACREAGE.

YOU HAVE A JULY 17 ECONOMIC COUNCIL.

USE THAT TO ASK DEVELOPERS AND INVESTORS FOR HOMES ON ACREAGE AND LARGE LOTS TO SHOW UP.

INSTEAD, WHAT I FOUND WHEN I TRIED TO COLD CALL PEOPLE IS, OH, ANNA ISN'T GOING TO DO ANYTHING BUT MULTIFAMILY AND SMALL LOTS.

NOW, SOME OF THAT IS HEARSAY FROM PEOPLE AS OLD AS ME, AS I KNOW IN HIGHLAND PARK, I'M GOOD FRIENDS WITH A LOT OF PEOPLE DOWN THERE, AND THEY JUST DON'T SEE ANNA AS LARGE LOTS IN ACREAGE.

YOU NEED TO CHANGE THAT IMAGE.

AS YOU KNOW WE'VE BEEN FOLLOWING THE STATE LEGISLATURE DOWN IN AUSTIN SINCE JANUARY AND EVEN BEFORE THAT.

I WANTED TO JUST GIVE A QUICK RECAP OF SEVERAL BILLS, CULMINATION OF SOME OF OUR WORK, AND WHAT'S TO COME IN THE NEXT FEW DAYS.

I'LL GO PRETTY QUICKLY.

THIS IS JUST A SAMPLE OF INFORMATION BECAUSE THERE WERE OVER 9,000 BILLS AND JOINT RESOLUTIONS THAT WERE FILED, AND ALMOST A QUARTER OF THOSE WERE RELATED TO CITIES IN TEXAS.

OF THOSE THAT PASSED ABOUT 13% OF THOSE FILED MADE IT INTO LAW, AND AGAIN, OVER 260 OF THOSE THAT RELATE TO CITIES.

THIS, AGAIN, I'M NOT GOING TO GO THROUGH ALL 262.

JUST A SAMPLE OF SOME OF THE THINGS THAT WE WORKED ON AS STAFF, AND I GIVE A LOT OF KUDOS TO SEVERAL OF OUR DEPARTMENTS WHO WORKED TOGETHER, GAVE INFORMATION, THE PROFESSIONAL ASSOCIATIONS THAT MANY OF US ARE A PART OF GIVE INPUT AND INFORMATION ON THOSE.

I WANT TO JUST GO INTO WHAT WE HEARD BACK IN JANUARY WITH THE GOVERNOR ABBOTT'S EMERGENCY ITEMS. MOST OF THOSE WERE SIGNED INTO LAW, PROPERTY TAX RELIEF IN THE FORM OF INCREASING THE SCHOOL HOMESTEAD EXEMPTION,

GENERATIONAL INVESTMENTS IN WATER, RAISING TEACHER PAY, EXPANDING CAREER TRAINING, SCHOOL CHOICE, BAIL REFORM, AND CREATING THE TEXAS CYBER COMMAND, WHICH WOULD BE THE LARGEST STATE BASED CYBERSECURITY DEPARTMENT IN THE COUNTRY.

SOME EXCITING STUFF.

SEVERAL OF THEM FALL UNDERNEATH YOUR LEGISLATIVE PRIORITIES, WHICH THIS BODY ADOPTED IN APRIL.

WE ENCOURAGE ON YOUR BEHALF, AND THOSE ARE PASSING THROUGH TO OUR REPRESENTATIVES AND OTHERS THROUGH TML, WE'RE ASKING THE LEGISLATOR TO CONTINUE TO PRESERVE LOCAL AUTHORITY, ADVOCATING AGAINST STATE PREEMPTION OF MUNICIPAL POWERS TO ENSURE DIRECT DECISIONS, REFLECT LOCAL COMMUNITY NEEDS.

TWO TO ENHANCE PUBLIC SAFETY.

SEEKING FUNDING AND LEGISLATIVE SUPPORT FOR LAW ENFORCEMENT RESOURCES AND THE LEGISLATURE DID DO THAT THIS SESSION.

INVESTING IN INFRASTRUCTURE TO PRIORITIZE FUNDING FOR TRANSPORTATION IMPROVEMENTS, WATER AND SEWER SYSTEMS, AND OTHER CRITICAL ITEMS FOR THE GROWTH OF THIS COMMUNITY AND OTHERS ACROSS TEXAS.

FINALLY, PROMOTING ECONOMIC DEVELOPMENT, SUPPORTING POLICIES AND PROGRAMS THAT WILL ATTRACT BUSINESSES, FOSTER ENTREPRENEURSHIP AND EXPAND THE LOCAL ECONOMY.

I'VE FRAMED THESE IN TERMS OF THOSE FOUR PRIORITIES AND THEN I'LL GET INTO SOME OF THE THINGS THAT WE WORKED REALLY HARD TO MAKE SURE THEY DIDN'T PASS, AND THEY DIDN'T, BUT WE WILL EXPECT THOSE TO COME BACK NEXT SESSION.

FIRST, PRESERVING LOCAL AUTHORITY, NUMBER ONE, HB 21 REFORMS THOSE HOUSING FINANCE CORPORATIONS, SO THEY MUST GAIN APPROVAL THROUGH A RESOLUTION OR ORDER FROM THE GOVERNING BODY OF EACH SPONSORING LOCAL GOVERNMENT WHEN OPERATING OUTSIDE OF ITS OWN JURISDICTIONS.

WE'VE HAD THAT HAPPEN IN THE METROPLEX IN ANNA THAT WILL BE A BIG HELP FOR US.

SB 1062 ALLOWS FOR DIGITAL NEWSPAPER NOTICES IN SOME INSTANCES.

WHAT WE'VE ALREADY SEEN AND STARTED ENACTING IS POSTING THE AGENDA FOR OPEN MEETINGS THREE BUSINESS DAYS, NOT JUST A GENERAL 72 HOURS.

THAT DOES MOVE THE TIMELINE UP.

THERE ARE TIMES THAT WE MAY NOT HAVE ALL THE INFORMATION IN THE PACKET TO BE ABLE TO POST THE MEETING, BUT WE'LL GET THOSE ADDED AS SOON AS WE CAN.

SOME OF THE THINGS THAT DID PASS THAT MAY HAVE BEEN PRESERVING LOCAL AUTHORITY, THAT'S WHY THEY'RE IN RED.

I APOLOGIZE FOR THOSE THAT MIGHT BE RED GREEN COLOR BLIND, BUT I CAN PUT THOSE IN ANOTHER FORMAT IF YOU NEED.

SB 15 ON TINY LOTS AND UNDEVELOPED AREAS.

THIS ALONG WITH SB 840, IT DOES HAVE SOME POPULATION BRACKETS FOR OVER 150,000 FOR THE CITY.

WHILE IT DOES NOT APPLY TO US RIGHT NOW, IT MIGHT BE SOMETHING THAT WE NEED TO BE AWARE OF IN THE FUTURE.

THIS WAS REFILED FROM LAST SESSION.

IT WAS A PRIORITY OF DAN PATRICK, WAS TO CAP THE MINIMUM LOT SIZE FOR GREEN FIELDS AND OTHER ZONING RESTRICTIONS FOR SMALL LOTS.

IF YOU'RE A CITY OVER 150,000, YOU'RE PRETTY MUCH LIMITED TO THOSE TINY LOTS NO MORE LARGE DEVELOPMENTS FOR YOU.

FOR SB 840 WAS ALLOWING MIXED USE AND MULTIFAMILY DEVELOPMENTS AND CONVERSIONS IN NON RESIDENTIAL AREAS.

IT ALLOWED IT ORIGINALLY AS FILED MULTIFAMILY TO GO IN ANY ZONING DISTRICT.

THAT'S SOMETHING THAT WE ARGUED AGAINST, AGAIN, THAT IS A POPULATION BRACKET, THAT DOES NOT APPLY TO US RIGHT NOW, BUT MAY IN THE FUTURE.

THERE WAS SB 1844, WHICH ALLOWS FOR THE DISANNEXATION OF MOST CITIES.

MOST CITY AREAS UNLESS THE CITY PROVIDES FULL MUNICIPAL SERVICES.

WE EXPECT THAT THIS MAY NEED TO GO THROUGH SOME OF THE TEXAS COURT SYSTEM.

IF SOMEONE'S ON SEPTIC OR BY CHOICE, OTHER AREAS, THERE'LL NEED TO BE SOME DEFINITIONS THAT MIGHT NEED TO BE WORKED OUT FROM THAT.

SB 785 AS FILED, WOULD HAVE ALLOWED MANUFACTURED HOMES IN ALL RESIDENTIAL DISTRICTS.

THE WAY IT ENDED UP COMING OUT WAS IT CLARIFIES THAT CITIES MUST ALLOW THE HUD CODE MANUFACTURED HOMES IN AT LEAST ONE RESIDENTIAL DISTRICT.

HB 4163 ALLOWS FOR AGRICULTURAL OPERATIONS, PREVENT CITIES FROM REQUIRING OWNERS OR LEASES OF AGRICULTURAL OPERATIONS TO MOW BE SHRED OR HOME MATERIALS ON A PUBLIC RIGHT OF WAY NEXT TO THEIR PROPERTY.

THEN HB 2559 PROHIBITS A CITY'S ABILITY TO ADOPT A DEVELOPMENT MORATORIUM WITHOUT CERTAIN PUBLIC HEARINGS AND NOTICES.

>> FOR ENHANCING PUBLIC SAFETY, THE UVALDE STRONG BILL TML WORKED WITH THE TEXAS CHIEFS ASSOCIATIONS OR T CORE PRETTY FREQUENTLY ON THIS ONE.

THIS IS A BILL THAT SOME OF THE THINGS THAT WE'RE ALREADY DOING, WORKING ON TABLETOP EXERCISES AND REPORTING REQUIREMENTS.

THAT WAS A GREAT BILL OF A SESSION FOR PUBLIC SAFETY.

ONE THAT WE ARE ALSO IN FAVOR OF WAS HB 1893, WHICH ALLOWS FOR LAW ENFORCEMENT AGENCIES TO RELEASE

THE LICENSE PLATE NUMBER OF A MOTOR VEHICLE THAT'S CAPTURED IN VIDEO RECORDINGS.

FOR 2373, SEEKS TO ENHANCE LEGAL PROTECTION FOR INDIVIDUALS AGAINST EMERGING THREATS POSED BY TECHNOLOGY.

FOR FINANCIAL SCAMS AND ABUSE, I'M GOING TO INSTITUTE PENALTIES AND CRIMINAL CHARGES AND SEEKS TO DETER MALICIOUS ACTIVITY, PROVIDING RECOURSE FOR VICTIMS OF FINANCIAL CRIMES WHEN IT COMES TO TECHNOLOGY THROUGH DIGITAL MEANS.

SB 2570 BY FLORES INTRODUCED A LEGAL FRAMEWORK PROVIDING THE DEFENSE FOR PEACE OFFICERS, PROSECUTED UNDER CERTAIN OFFENSES FOR LESS LETHAL PROJECTILE.

FOR EXAMPLE, AN OFFICER USES A TASER IN THE WAY THAT IT WAS MANUFACTURED AND BY POLICY, THERE COULD BE SOME CLARIFICATIONS AND LEGAL PROTECTIONS FOR THAT OFFICER.

I MENTIONED FUNDING RESOURCES.

THERE'S A NUMBER OF GRANTS FOR PUBLIC SAFETY THAT WERE APPROVED IN ROLE FIRE DEPARTMENTS THIS SESSION.

WE'RE GRATEFUL FOR THE LEGISLATURE FOR THOSE.

ALSO, IN REGARDS TO FUNDING, HJR 7 AND SB 7, IF APPROVED BY VOTERS IN NOVEMBER, WILL DEDICATE $1 BILLION A YEAR FOR 20 YEARS TO THE TEXAS WATER DEVELOPMENT BOARD FOR WATER PROJECTS IN THE STATE.

THAT WILL BE ON THE BALLOT THIS NOVEMBER.

THEN SB 1173 INCREASES THE PUBLIC BIDDING THRESHOLD FROM 50,000-100,000 JUST WITH THE COST OF PROJECTS, THAT WILL SAVE A LOT OF TIME AS WELL.

SB 924 REMOVES THE FRANCHISE FEE THAT CITIES CAN COLLECT ON STREAMING SERVICES.

THAT'LL BE A SLIGHT HIT FOR US.

RIGHT NOW, WE CHARGE FRANCHISE FEES FOR THOSE LIKE FOR NETFLIX AND OTHERS.

THERE WAS SOME OPPOSITION FOR CITIES, AND A LOT LARGER THAN US.

THAT WILL BE A BIG HIT, BUT IT WILL BE A DECREASE.

FOR HB 9 OR HJR 1 INCREASES TO THE BUSINESS PERSONAL PROPERTY TAX EXEMPTION.

AGAIN, THIS WILL BE A CONSTITUTIONAL AMENDMENT THAT'LL BE ON THE NOVEMBER BALLOT.

IF PASSED, IT'LL PROVIDE A PROPERTY TAX EXEMPTION FOR $125,000 OF THE MARKET VALUE OF TANGIBLE BUSINESS PERSONAL PROPERTY.

PREVIOUSLY, THE BASELINE WAS LESS THAN $2,500 OF TAXABLE VALUE, AND THAT WOULD GO INTO EFFECT ON JANUARY 1.

WE'LL BE TAKING A LOOK AT THAT WITH THIS YEAR'S BUDGET AS WELL.

FOR ECONOMIC DEVELOPMENT, THE CITY AND THE EDC WORKED WITH REPRESENTATIVE LEACH AND SENATOR PAXTON TO CREATE QUALIFIED HOTEL PROJECTS WITHIN THE CITY OF ANNA.

UNFORTUNATELY, THAT GOT SWEPT UP IN CALENDARS AND ENDED UP DYING IN THE SENATE.

NEITHER OF THOSE DID PASS, BUT WE WILL TRY AGAIN NEXT SESSION.

THEN FOR HB 500, IT APPROPRIATES UNEXPENDED AND UNOBLIGATED AN ESTIMATED $573 MILLION FROM LAST SESSION TO THE TEXAS SEMICONDUCTOR INNOVATION FUND.

THAT WOULD BENEFIT THOSE CITIES TO OUR NORTH AND TO SOUTH.

THAT COULD ALSO IMPACT US.

THAT WAS LAST SESSIONS CHIPS ACT, ENCOURAGING SOME SEMICONDUCTOR INVESTMENTS IN THE REGION.

RISING TIDE LIFTS ALL BOATS.

WE DID HAVE SOME GOOD WINS THIS SESSION, AS I MENTIONED, BUT WE DID SPEND A LOT OF TIME WORKING ON SOME OF THESE ITEMS THAT WE WILL EXPECT TO SEE BACK NEXT SESSION OR EVEN POTENTIALLY IN THE SPECIAL SESSION THAT THE GOVERNOR HOUSE CALLED TO START ON THE 21ST.

EXPENDITURE CAPS, SUCH AS REQUIRING A CITY TO HOLD A NOVEMBER ELECTION IF THEY WERE TO SPEND MORE THAN THE PREVIOUS YEAR.

THAT WAS A LOT OF TIME.

HB 19 LIMITED THE AMOUNT OF DEBT AND HOW CITIES COULD USE IT, EVEN MORE THAN EXISTING.

SOME BILLS EVEN ALMOST DID AWAY WITH 380 ECONOMIC DEVELOPMENT AGREEMENT OR ELIMINATING THE ETJ WAS A BILL, REQUIRING A THIRD PARTY REVIEW OR PROVIDING AN OPTIONAL THIRD- PARTY REVIEW.

IF A DEVELOPER CAME IN AND SUBMITTED THEIR PLANS, STAFF REVIEWS THEM AND THEY DISAGREED WITH THAT, THEY COULD ASK FOR A THIRD-PARTY REVIEW AT THE CITY'S EXPENSE TO ALSO REVIEW THOSE PLANS.

THAT DID FAIL, BUT WE EXPECT TO SEE THAT BACK.

THERE WAS A REQUIREMENT TO ALLOW FOR ALL RESIDENTIAL USES INCLUDING MULTIFAMILY AND RELIGIOUS OWN LAND,

WHICH AS MANY OF YOU KNOW, RELIGIOUS OWN LAND CAN GO IN ANY DISTRICT.

AGAIN, MULTIFAMILY IN ANY DISTRICT. CONDO PREEMPTIONS.

THERE'S A SUPER PREEMPTION BILL THAT ALLOWED THE ATTORNEY GENERAL TO INVESTIGATE ANY CITY ORDINANCE AT ANY TIME, AND IF THEY DIDN'T LIKE WHAT THEY FOUND, THEY COULD HOLD ALL YOUR TAXES, ESPECIALLY YOUR SALES TAX.

GO INTO MORE DETAIL. THERE'S SOME SEVERAL PUBLIC INFORMATION ACT CHANGES, SHORTENING SOME DEADLINES, REQUIRING MORE TRAINING.

THERE WAS ONE BILL FROM SENATOR BETTINACURT THAT WOULD REQUIRE EVERY PUBLIC MEETING TO BE BROADCASTED ON THE CITY'S WEBSITE.

THERE ARE SEVERAL PUBLIC MEETINGS.

WE DO A LOT OF THAT ALREADY.

THAT MIGHT BE VERY ONEROUS FOR SMALLER CITIES, MUCH SMALLER THAN US.

COMMUNITY CENSORSHIP SB 19 WOULD HAVE PROHIBITED THE USE OF PUBLIC FUNDS FOR LOBBYING SERVICES.

THIS MAY BE INCLUDED IN THE SPECIAL SESSION.

THAT WOULD ESSENTIALLY ELIMINATED THE USE OF TML TO GET INFORMATION SUCH AS THIS, OR POSSIBLY ANY OTHER PROFESSIONAL DEVELOPMENT ORGANIZATION THAT MIGHT BE ADVOCATING FOR CITY SERVICES IN AUSTIN.

PUBLIC SAFETY. WE WERE WATCHING THE SB 241 ON ENFORCING PUBLIC CAMPING VANS, AS WELL AS INCLUDING LANGUAGE ALLOWING LICENSE CARRY AND LEAST OWN CITY PROPERTIES.

FOR INSTANCE, THE CITY OF FRISCO OWNS THE LAND THAT THE ROUGH RIDERS PLAY ON, AND SOME OF THOSE MAY OR MAY NOT ALLOW FOR LICENSED CARRY.

THERE WAS SOME CONVERSATION ABOUT WHAT THAT MIGHT LOOK LIKE.

THOSE DID NOT MAKE IT THROUGH THE CALENDAR.

AS USUAL, EVERY SESSION THERE'S A BILL ELIMINATING THE MAY ELECTION DATES AND MOVING ALL ELECTIONS, ESPECIALLY DEBT ELECTIONS TO NOVEMBER.

FINALLY, ONE WAS VERY INTERESTING THIS YEAR, THE UTILITY RELOCATION.

IF WE HAD A PROJECT, USUALLY WE CAN ASK THE UTILITY COMPANY TO MOVE THEIR UTILITIES.

THIS WOULD REQUIRE US TO HAVE TO PAY FOR THOSE, WHICH WOULD BE SIGNIFICANT FOR A LOT OF OUR RIGHT AWAY PROJECTS AND INFRASTRUCTURE PROJECT.

WHAT WAS INTERESTING THOUGH, IS THAT WOULD NOT HAVE APPLIED TO TEXTO.

IF THERE'S A TEXTO PROJECT, AS WE DO NOW, WE WOULD HAVE TO MOVE OUR UTILITIES FOR THEIR PROJECTS. VERY INTERESTING.

BUT WAIT, THERE'S MORE.

THE GOVERNOR HAS ANNOUNCED A SPECIAL SESSION TO BEGIN ON JULY 21ST.

THE SPECIFIC AGENDA HAS NOT BEEN RELEASED YET IN HIS PRESS RELEASE, HE NAMED A FEW BILLS, INCLUDING SENATE BILL 3 THAT DID NOT PASS THIS LAST SESSION.

THAT WAS THE PRIORITY OF LIEUTENANT GOVERNOR DAN PATRICK, THAT WOULD HAVE PROHIBITED THE SALE OF NEARLY ALL CONSUMABLE HEMP PRODUCTS CONTAINING THC.

PRESS RELEASE ALSO REFERENCED RECORDING REQUIREMENTS FOR CERTAIN INSTRUMENTS CONCERNING REAL PROPERTY, PRODUCTION AND FEES FOR CERTAIN WATER PROJECTS, AND THE REGULATION OF WELLS.

HE ALSO MENTIONED CEMENT BATCH PLANTS, AND NEXUS SEMICONDUCTORS AS WELL AS PROCEDURES RELATED TO THE JUDICIAL BRANCH.

WE'LL BE KEEPING AN EYE ON THAT.

TAKING AWAY RESOURCES THAT WE COULD INVEST IN INFRASTRUCTURE.

I WOULD SAY THAT THAT COULD FALL WITHIN THOSE.

THE BIG WIN FOR THAT WOULD BE THE CONSTITUTIONAL AMENDMENT FOR THE TEXAS WATER BOARD REDEVELOPMENT FUNDING SO THAT WILL BE ON THE BALLOT THIS NOVEMBER.

THEN PROMOTING ECONOMIC DEVELOPMENT, THEN THERE'S GOING TO BE BILLS EVERY SESSION WHERE LEGISLATURE WANTS TO TAKE THE TOOLS OUT OF THE TOOLBOX THAT WE CAN USE TO RETRACT AND RETAIN COMMERCIAL BUSINESS.

WE ADD THAT TO THE VERSE OF FAIR TAX BASE.

I UNDERSTAND THAT THAT IS THE NEXT STEP IN THE PROCESS AND DON'T HAVE A PROBLEM WITH THAT.

I WOULD LIKE TO TAKE THIS OPPORTUNITY TO ONCE AGAIN PUBLICLY REMIND THIS COUNCIL AND EVERYONE ELSE THAT THE PRE-ANNEXATION DEVELOPMENT AGREEMENT THAT WAS APPROVED BY THIS COUNCIL DID NOT GO BACK TO THE PLANNING AND ZONING COMMISSION BEFORE IT CAME TO YOU.

SHARP POINTED OUT, WHICH WAS NOT IN THE AGENDA WHEN THE DISCUSSION OF THIS ITEM WAS ON PLANNING AND ZONING, THERE WAS NO ACTION ITEM, IS NOT IN COMPLIANCE WITH THE 2050 MASTER PLAN UPDATE THAT YOU ALL AND MANY OF US AND CITY STAFF SPENT MONTHS REVIEWING AND COMMENTING ON, AND THAT YOU FINALLY APPROVED.

SPECIFICALLY, THERE ARE THREE ELEMENTS IN THAT DEVELOPMENT PLAN AS A LAY PERSON THAT I CAN SEE VERY EASILY ARE NOT IN COMPLIANCE.

ONE OF THEM IS THAT THERE ARE TOWNHOUSES ON LAND THAT WAS DESIGNATED AS SUBURBAN LIVING, WHICH IS 6,000 SQUARE FOOT LOTS.

THERE'S SEVERAL MULTIPLE ACRES THAT HAVE TOWNHOUSES.

IN THAT SAME AREA, THERE IS A SIGNIFICANT COMMERCIAL PRESENCE ON THAT LAND THAT WAS DESIGNATED, APPROVED IN THAT MASTER PLAN UPDATE AS SUBURBAN LIVING, 06,000 SQUARE FOOT LOTS.

IN ADDITION TO THAT, ON THE OTHER SIDE OF THE ROAD, THERE ARE A NUMBER OF 40 BY 110-FOOT LOTS.

AGAIN, 4,400 SQUARE FEET IN LAND THAT WAS DESIGNATED AS SUBURBAN LIVING, 06,000 SQUARE FOOT LOTS.

WHEN I WAS ABLE TO GET A COPY OF THE CONCEPT PLAN, I ATTEMPTED TO EXPRESS THESE CONCERNS TO PLANNING AND ZONING, AND AS MS. SHARP INDICATED TO YOU EARLIER, WAS BLOCKED FROM MAKING THOSE COMMENTS, SINCE IT WAS NOT A PUBLIC HEARING ITEM.

IT WAS AN INFORMATION ITEM.

IN THE PAST, WE'VE BEEN ABLE TO MAKE COMMENTS, ASK QUESTIONS, REQUEST INFORMATION THROUGH THE STAFF TO PLANNING AND ZONING, AND BASED ON THE EMAILS THAT I RECEIVED BACK FROM THE FORMER ASSISTANT CITY MANAGER, THE PREVIOUS CITY MANAGER HAD CUT OFF THAT AVENUE OF COMMUNICATION.

I'D LIKE FOR YOU TO RECONSIDER THAT, AND I HOPE THAT THE ACTING CITY MANAGER AND WHOEVER THE FINAL CITY MANAGER IS, WHOEVER HE OR SHE MAY BE, REINSTATES THAT AVENUE OF COMMUNICATION, BECAUSE WE'RE NOT ATTEMPTING TO BE A THORN IN ANYBODY'S SIDE, WE'RE ATTEMPTING TO BE AS A POSITIVE PART OF THE PROCESS, AND OFFER COMMENTS AND INFORMATION THAT WE BELIEVE IS PERTINENT TO THE PROCESS, AND THAT'S ALL WE REALLY WOULD LIKE TO DO.

THIS IS A 25-YEAR TRANSACTION, AS WE DISCUSSED.

WE TAKE INTO ACCOUNT THE PRELIMINARY VALUES THAT WERE PROVIDED BY COLLIN COUNTY APPRAISAL DISTRICT FOR TAX YEAR 2025, AND THIS IS BIFURCATED INTO A PORTION OF THE PROJECT, THE 30 MILLION TO BE PAID BACK VIA THAT SERVICE PROPERTY TAXES, AND THE REMAINDER VIA SURPLUS REVENUES FROM THE WATERWORKS AND SEWER SYSTEM.

THE FINAL INTEREST RATE THAT WE GOT HERE WAS 4.77% AND THAT IS FIXED FOR THE ENTIRE TERM OF THE TRANSACTION.

THE BUDGETED INTEREST RATE THAT WE DISCUSSED BACK IN MAY WAS 4.98, SO WE CAME IN UNDER A BUDGET.

THE BEST BID CAME IN FROM BOK FINANCIAL SECURITIES, WHICH IS A BRANCH OF THE BANK OF OKLAHOMA, BANK OF TEXAS.

THEY HAVE WORKED WITH THE CITY BEFORE, AND THEY PUT IN THE BEST BID AT 4.77% ROUNDING UP.

THE SECOND BEST WAS BANK OF AMERICA AT 4.78, ROUNDING UP AS WELL.
