I'M HERE TO ADDRESS ONE OF THE ISSUES INVOLVING THE RAVINE THAT RUNS FROM COUNTY ROAD 1106 TO THE RETENTION AREA POND ON ELAM DRIVE BETWEEN DUMAS AND MCKINNEY STREET. AS A HOMEOWNER, MY HOUSE IS NOT DIRECTLY AFFECTED BY THIS ISSUE. IT DOES IMPACT THE FUTURE STABILITY OF MY HOUSE. HOWEVER, IT IS MY FIRM BELIEF, THE HOMEOWNERS OF NORTH POINTE CROSSING SHOULD NOT BE HELD RESPONSIBLE FOR ANY COSTS ASSOCIATED WITH THE REPAIR OF THE RAVINE. THE EROSION WAS CAUSED BY THE DEVELOPER REMOVING VEGETATION, WHICH MAINTAINED THE INTEGRITY OF THE GROUND AND WOULD HAVE, AT A MINIMUM, MINIMIZED THE EROSION. THE HOMEOWNERS HAVEN'T HAD NO RESPONSIBILITY REGARDING THE DEVELOPMENT OR APPROVAL OF THE PLANS FOR THE SUBDIVISION. [00:05:07] CITY OF ANNA APPROVED THE PLANS AND FAILED TO RECOGNIZE ANY POTENTIAL ISSUES THAT COULD ARISE WHILE DEVELOPING THIS LAND. DEVELOPERS SHOULD NOT HAVE ALSO POINTED OUT ANY POTENTIAL ISSUES THAT MIGHT OCCUR AS A RESULT OF THE DEVELOPMENT OF THAT AREA. I UNDERSTAND THAT AT THE POINT IN TIME, ANNA WAS A SMALL TOWN LOOKING TO GROW. HOWEVER, THE CITY HAD A RESPONSIBILITY TO ENSURE DUE DILIGENCE WAS ACCOMPLISHED. I DO WANT TO POINT OUT THE REASON WHY, IN THE RESOLUTION, IT TALKS ABOUT APPROVED AS TO FORM BY THE CITY ATTORNEY IS IF THERE ARE ANY SMALL TWEAKS AS WE WORK THROUGH WITH THE HOA, THAT LANGUAGE ALLOWS US TO MAKE SURE AS LONG AS CLARK IS GOOD WITH IT, WE'RE NOT MAKING ANY SIGNIFICANT CHANGES AND MATERIAL CHANGES THAT WE CAN GO AHEAD AND MOVE FORWARD, WE DON'T HAVE TO BRING IT BACK TO YOU. WE DID PROVIDE THE AGREEMENT TO THE HOA PRESIDENT FOR REVIEW LAST WEEK. I WANT TO MAKE SURE WE GIVE HIM AND THE BOARD AN APPROPRIATE AMOUNT OF TIME SO THEY CAN REVIEW IT AND COME BACK TO US. HE DID GIVE US SOME INITIAL FEEDBACK. HAD SOME MINOR COMMENTS. THEY WERE ALL VERY GOOD, STAFF HAD NO ISSUES WITH THEM. BUT WE WANT TO MAKE SURE THAT THEY'RE COMFORTABLE WITH IT, THAT WE'RE NOT JUST FORCING THIS AGREEMENT ON THEM. I'LL RUN THROUGH THE MAJOR DEAL POINTS, WHERE WE SETTLED OUT AFTER CONVERSATIONS WITH THE HOA PRESIDENT AND JUST OUR FACT-FINDING IS THAT THIS AGREEMENT PROPOSES A 50/50 FUNDING MATCH. THE TOTAL PROJECT FUNDING WOULD BE $200,000. THE HOA WOULD DEPOSIT $100,000 INTO A SPECIAL CITY ACCOUNT THAT CAN ONLY BE USED FOR THIS PROJECT. WE WOULD THEN, AS A CITY, WOULD PROVIDE THE MATCH, 50/50, SO WE WOULD PLACE $100,000 AS WELL. THE CITY WOULD MANAGE THE DESIGN AND THE CONSTRUCTION, AND WE WOULD ACTUALLY DO THE DESIGN WORK AS MUCH OF IT AS WE POSSIBLY CAN IN-HOUSE SO THAT WE CAN TRY TO FOCUS THE MAJORITY OF THAT MONEY ON CONSTRUCTION AND NOT SPENDING A LOT OF MONEY ON DESIGN. BETWEEN WEST LAWSON AND I, AS ENGINEERS, AND THEN WITH STEVEN SMITH, OUR PUBLIC WORK DIRECTOR, HIS EXPERIENCE IN CONSTRUCTION, AND HIS TEAM, WE FEEL LIKE WE CAN PRETTY GOOD JOB OF A GOOD IN-HOUSE DESIGN ON THE PROJECT AND SAVE MONEY. WE MAY NEED TO GET A LITTLE BIT OF SURVEY WORK DONE JUST TO GET SOME GOOD DATA, BUT THAT WILL BE A MINOR COST. >> THE CITY WILL THEN PROVIDE TO THE HOA A PRESENTATION OF THE DESIGN, SO WE WILL GO TO THE HOA AND GET THEIR FEEDBACK ON THE DESIGN, ALLOW THEM THE OPPORTUNITY TO PROVIDE US INPUT, THEN WE CAN MAKE ANY CHANGES AND ADJUST FROM THERE BEFORE WE GO TO CONSTRUCTION. OUR GOAL WILL BE TO AND WHAT'S REQUIRED IN THE AGREEMENT IS THAT THE CITY WOULD COMMENCE CONSTRUCTION WITHIN 120 DAYS OF THE HOA DEPOSITING THEIR FUNDS. BASICALLY FOUR MONTHS THAT SETS A MAXIMUM. WE MAY BEAT THAT, WE'D LIKE TO BEAT THAT, BUT FOUR MONTHS FOR US TO GO THROUGH DESIGN PROCESS, PRESENT IT TO THE HOA, GET THEIR FEEDBACK, MAKE ANY ADJUSTMENTS, AND THEN GET GOING. THEN WE HAVE TO COMPLETE THE CONSTRUCTION WITHIN 180 DAYS AFTER THE COMMENCEMENT DEADLINE. NOW I KNOW 180 DAYS SOUNDS LIKE A LOT OF TIME. BUT AS WE WORK THROUGH THIS, JUST DEPENDING ON THE SEASONS AND THE WEATHER, IF WE HIT THE WRONG PERIOD OF TIME, WE COULD LOSE 30 DAYS JUST FROM RAIN. >> ALL RIGHT. >>WITH A DRAINAGE CHANNEL THAT HAS EROSION PROBLEMS, THE ONLY WAY THAT YOU CAN MAKE IT EVEN WORSE IS TO GO OUT THERE WHEN IT'S ALL MUDDY AND TEAR IT UP. WE JUST WANT TO BE VERY SPECIFIC ABOUT THAT. AND WE'RE OPEN TO HAVING THOSE CONVERSATIONS WITH THE NEIGHBORS AS WE GET A DESIGN [02:15:04] UNDERWAY AND WE LOOK AT HOW MUCH ROOM AND SPACING WE HAVE FOR EQUIPMENT AND EVERYTHING, TALKING TO NEIGHBORS ABOUT THAT. BUT, THERE ARE SOME OLDER FENCES ALONG THIS DRAINAGE CHANNEL AND SOME OF THEM ARE IN PROBABLY TOWARDS THE END OF THEIR LIFESPAN. WE JUST WANT TO ACKNOWLEDGE THAT AND MAKE SURE IT'S CLEAR AND EVERYONE UNDERSTANDS THAT THIS IS NOT A PROJECT TO REPLACE FENCES. THIS IS PROJECT IS FOCUSED ON THE EROSION IN THE DRAINAGE CHANNEL. THEN ONCE THE PROJECT IS COMPLETE, THE CITY WILL REIMBURSE THE HOA ANY OF THEIR FUNDS THAT ARE NOT SPENT. AS A 50/50 MATCH. IF WE SPEND 150,000, THEN THERE'S 50,000 LEFT, 25 GOES BACK TO THE CITY, 25 GOES BACK TO THE HOA. THAT WAY, WE'RE BEING FAIR TO THEM AND NOT SPENDING THEIR MONEY FIRST AND THEN OURS OR ANY WEIRD THINGS LIKE THAT. WE'RE GOING TO SPLIT IT 50/50, KEEP IT A 50/50 ALL THE WAY THROUGH. NOW, THE LAST THING IS THE HOA WILL AGREE TO MAINTAIN THE DRAINAGE AFTER COMPLETION OF CONSTRUCTION. THIS DOESN'T NECESSARILY PROHIBIT THEM FROM ASKING US FOR ASSISTANCE IN THE FUTURE, THAT WOULD THEN BE A COUNCIL DECISION. BUT IT JUST REAFFIRMS THE FACT THAT OUR ORDINANCES AND EVERYTHING THAT THE INITIAL RESPONSIBILITY FOR MAINTENANCE OF DRAINAGE ON PRIVATE PROPERTY IS ON THE PROPERTY OWNER THEMSELVES. WE JUST WANT TO MAKE SURE THAT WE'RE CLEAR THAT WE STILL MAINTAIN THAT BASIC UNDERLYING POLICY, BUT UNDERSTAND THAT THERE ARE SITUATIONS LIKE THIS WHERE IF THE COUNCIL IS AGREEABLE, THE COUNCIL HAS THE AUTHORITY TO CHOOSE TO DO PARTICIPATION IN PROJECTS.
