WE'RE GOING TO MOVE ON TO ITEMS FOR INDIVIDUAL CONSIDERATION.

SIX AYES IS CONDUCTED PUBLIC HEARING TO CONSIDER DISCUSS ACTION ON AN ORDINANCE TO AMEND AN EXISTING PLAN DEVELOPMENT, ORDINANCE NUMBER 648, 2014 ON 12.2 ACRES LOCATED ON THE SOUTH SIDE OF HACKBERRY DRIVE, 160 FEET EAST OF US 75, TO ALLOW FOR BUILDING MATERIALS HARDWARE INDOORS WITH MODIFIED DEVELOPMENT STANDARDS.

>> THE ZONING CASE BEFORE YOU IS AN AMENDMENT OF AN EXISTING PLAN DEVELOPMENT.

THERE IS A POTENTIAL TENANT, THE HOME DEPOT, WHO IS WANTING TO COME INTO THIS PROPERTY AND IN ORDER TO MEET THEIR TYPICAL OPERATIONS.

THEY NEED TO AMEND THE ZONING FOR THE EXISTING OUTDOOR DISPLAYS, SPECIFICALLY THE GARDEN CENTER, ADDING VEHICLE AND TRAILER RENTALS AS AN ACCESSORY USE.

WE DID HAVE THEM AGREE TO IMPROVING THE LANDSCAPING ON BUDDY HAYES BOULEVARD AS WELL AS HACK BARRY AND THE AREAS WHERE THEY'RE GOING TO HAVE SOME OUTDOOR STORAGE.

THEN THEY ARE NEEDING TO REDUCE THEIR PARKING REQUIREMENT.

THIS WOULD BE A REDUCTION OF 136 SPACES, BUT THEY'RE STILL PROVIDING WELL OVER 400 SPACES AND SPECIFICALLY, THEY CANNOT PARK THEIR RENTAL VEHICLES IN ANY OF THE CUSTOMER PARKING SPACES.

THEY ARE ALSO REQUESTING TO INCREASE THE MAXIMUM WALL SIGNAGE DUE TO THE NUMBER OF ENTRANCES.

THEIR MAIN SIGN IS ALREADY WELL OVER THE MINIMUM OR THE MAXIMUM WALL SIGNAGE, BUT THEN THE OTHER SIGNS EXCEED AS WELL.

FOR THE GARDENING CENTERS, THEY'RE REQUESTING TO INCREASE THE SIZE AND TO CHANGE THE SURROUNDING OF THE GARDEN CENTER AND THIS IS IN LINE WITH THE EXISTING TENANT WHO HAS THE SAME REGULATION.

THE PLANNING AND ZONING COMMISSION RECOMMENDED APPROVAL AND WE RECEIVED ONE LETTER IN FAVOR AND ONE NEUTRAL.

THIS IS THE COMPLETE REWRITE OF THE CITY ZONING REGULATIONS, WHICH INCLUDE ALSO OUR LANDSCAPE REGULATIONS.

THESE REGULATIONS THAT ARE BEFORE YOU THIS EVENING BASICALLY, THEY HIT FOUR MAJOR ACTION ITEMS THAT ARE INSIDE THE ANNA 25TH, THE COMPREHENSIVE PLAN, WHICH ARE LOCATED IN THE FUTURE LAND USE, ECONOMIC DEVELOPMENT, HOUSING AND PARKS AND TRAILS.

ADDITIONALLY, THE AUGUST 7TH PLANNING AND ZONING COMMISSION, THEY RECOMMENDED APPROVAL UNANIMOUSLY.

HOWEVER, SINCE THAT TIME, STAFF HAS IDENTIFIED FOUR OTHER ISSUES THAT WE WOULD LIKE YOU ALL TO CONSIDER AS OPTION 2.

THOSE FOUR ISSUES PERTAIN TO EXEMPTING THE DOWNTOWN FROM THE THOR OVERLAY DISTRICT, CHANGING GROUP PROBE AND WINERIES TO BE PERMITTED BY RIGHT WITHIN THE C1 ZONING DISTRICT.

SO CHANGE TASTING ROOMS TO BE ALSO BE ALLOWED, PERMITTED BY RIGHT WITHIN THE C1 ZONING DISTRICT, AND THEN TO EXEMPT THE ANNA DOWNTOWN ZONING DISTRICT FROM A SUBSECTION ASSOCIATED WITH THE SALE OF ALCOHOL BEVERAGES.

SO THAT WOULD BE STAFF'S RECOMMENDATION THAT YOU GO WITH THE OPTION 2 AMENDMENT WE HAVE WITH US THIS EVENING, FREEZE AND NICKELS, DANIEL HARRISON AS WELL AS WILSON KERR.

OUR TEAM HAS WORKED WITH THEM TO DEVELOP THE UPDATE TO THE ZONING ARTS, WHICH I'M GOING TO TAKE JUST 10 MINUTES TO WALK YOU THROUGH REALLY QUICKLY AND CONCLUDE WITH THAT OPTION 2 WILL HIGHLIGHT THOSE ONCE AGAIN, WHEN WE'RE LOOKING AT HOT DAY IN THE ZONING ORDINANCE, OF COURSE, WE HAVE A TOP TEN LIST, BUT REALLY, WHAT IT BOILS DOWN TO IS WE ARE IMPLEMENTING ITEMS FROM YOUR CURRENT PLANNING DOCUMENTS, FROM YOUR COMPREHENSIVE PLAN, THOSE TYPE OF VISION DOCUMENTS THAT LET US KNOW WHERE WE WANT TO GO, AND ALSO MAKING A MODERN DOCUMENT THAT'S GOING TO BE USEFUL FOR YOUR COMMUNITY DEVELOPERS AND YOUR STAFF, YOU AND YOUR P AND Z TO IMPLEMENT.

THE ZONING ORDINANCE IS DIVIDED INTO TEN DIVISIONS.

I'M REALLY GOING TO FOCUS ON A FEW THAT I THINK ARE GOING TO BE MORE OF INTEREST TO YOU.

WHEN WE TALK ABOUT ZONING DISTRICT OR DIVISION 2, WE HAD 27 ZONING DISTRICTS.

WE WERE ABLE TO LOOK AT THOSE AND SEE SOME REDUNDANCIES HERE.

WE'VE REDUCED THAT DOWN TO 18 ZONING DISTRICTS.

WE HAVE A NICE EQUIVALENCY TABLE, WHICH I'LL SHOW YOU HERE SO EVERYONE CAN SEE HOW THOSE GOT CONSOLIDATED.

WE ALSO HAVE A PURPOSE STATEMENT.

SO WHEN WE LOOK AT THESE DISTRICTS, WE KNOW WHAT THEY ARE INTENDED TO BE FOR.

HERE'S JUST AN EXAMPLE THAT EQUIVALENCY TABLE, WHERE WE SEE ALL THE CURRENT ZONING DISTRICTS LISTED ON THE LEFT COLUMN, THE NEW ZONING DISTRICTS AS THEIR PROPOSED AND THEN NOTES EXPLAIN WHY THOSE WERE COMBINED.

AND WE'LL TAKE A LOOK AT SOME OF THOSE HERE, SUCH AS THE MIXED-DENSITY DISTRICT.

WHAT THIS DOES IS ALLOW FOR A MEDIUM DENSITY RESIDENTIAL.

SOME DIVERSIFICATION AND HOUSING CHOICES AND THE RANGE THAT WE HAVE.

SO THIS WOULD BE A MIX OF SINGLE-FAMILY AND TWO-FAMILY.

THIS REALLY IMPLEMENTS THE CONFERENCE OF PLANS.

WE HAVE DIFFERENT PLACE TYPES AND THE CONFERENCE OF PLAN.

AND THIS WOULD BE ADDRESSING THE CLUSTER RESIDENTIAL AND THE URBAN LIVING.

ALSO WHEN WE HAVE THESE TYPE OF DISTRICTS THAT ALSO LESSENS THE DEMAND FOR APD REQUESTS COMING TO P AND Z AND COUNCIL FOR APPROVAL.

WHEN WE LOOK AT OUR COMMERCIAL ZONING DISTRICT SAME PROCESS THERE, WE WERE ABLE TO COMBINE SOME OF THOSE.

WE DO HAVE TWO NEW DISTRICTS THAT I'LL HIGHLIGHT HERE IN JUST A SECOND.

THE FIRST ONE BEING THE MIXED-USE DISTRICT.

AND THIS IS FOR DEVELOPMENT REALLY OUTSIDE OF THE DOWNTOWN AREA.

THIS WOULD BE PROVIDING AREAS FOR ENTERTAINMENT VENUES, COMMERCIAL, OFFICE USES, COEXISTING AND HIGHER DENSITY PEDESTRIAN FRIENDLY ENVIRONMENTS, AND THIS IS AN IMPLEMENTATION OF THE COMPREHENSIVE PLANS, PLACE TYPES FOR ENTERTAINMENT CENTERS AND MIXED-USE CENTER PLACE TYPES.

ONCE AGAIN, TRYING TO LESSEN THAT DEMAND FOR PD DEVELOPMENT.

JUST SOME OF THE INTERESTING THINGS YOU MAY WANT TO KNOW ABOUT THE MIXED-USE DEVELOPMENT, WE START TO INTRODUCE BUILD-TO-LINES.

THIS WOULD BE BRINGING BUILDINGS CLOSER TO THE STREET, HAVING A ZONE SO IT'S NOT NECESSARILY HOW FAR DO YOU NEED TO BE SET BACK FROM THE ROAD, BUT THIS IS THE ZONE WHERE THE BUILDING WOULD NEED TO BE HELPING CREATE THAT ONCE AGAIN, THAT WALK ABLE NEIGHBORHOOD AREA THE OTHER ONE WAS THE DOWNTOWN DISTRICT, AND THIS IS A NEW DISTRICT.

THIS IS AN IMPLEMENTATION OF THE DOWNTOWN MASTER PLAN AND CREATING A MIXED-USE DISTRICT WHICH IS GOING TO BE WORKABLE AND WE WANT TO ALLOW SOME FLEXIBILITY IN DESIGN AND THE DISTRICT DOES THAT.

THIS IS A COURSE TO HELP REVITALIZE AND BUILD UPON THE HISTORIC DOWN TOWN AND TO STIMULATE BUSINESS GROWTH.

IN THE DOCUMENT, YOU'LL HAVE THE DOWNTOWN CORE, THE CORE AREA, AND THE NEIGHBORING DISTRICT THAT GOES AROUND THE MORE RESIDENTIAL AREA.

HERE ON THE USE CHART YOU CAN SEE THE DIFFERENT TYPES OF RESIDENTIAL USES WE HAVE, AND THEN WHERE ARE THOSE ALLOWED AND THOSE TWO SUB-DISTRICTS OF THE DOWNTOWN.

WHEN WE GO INTO THE DOWNTOWN AREA, WE ALSO HAVE BUILD-TO-ZONES.

THOSE ARE DEPENDING ON WHAT TYPE OF STREET FRONTAGE YOU ARE BECAUSE IT'S GOING TO BE A LITTLE BIT DIFFERENT.

IF YOU'RE ON A MORE HEAVILY TRAVELED STREET AND A LESS TRAVELED STREET, SO WE HAVE THAT ALL FACTORED INTO THOSE TYPES OF CONSIDERATIONS.

WHEN WE TALK ABOUT PLAN DEVELOPMENT, ZONING DISTRICTS ARE GOING TO BE PRESENTED TO YOU.

WE DID ADD A NEW REQUIREMENT THAT THERE'S A MINIMUM FIVE CONTIGUOUS ACRES FOR THAT.

THIS IS TO HELP HAVE A COHESIVE DEVELOPMENT RATHER THAN GETTING REALLY SMALLER PIECEMEAL.

ONE LOT DEVELOPMENTS REQUESTING A PD.

THIS WILL HELP REDUCE THAT REQUESTS FOR PLANNED DEVELOPMENT ZONING.

WHAT THE DEVELOPER'S PROPOSING THEN IS IN LIEU OF THE PARK DEVELOPMENT FEES THAT ARE TYPICALLY PAID ON A PER LOT BASIS FOR SINGLE-FAMILY RESIDENTIAL AND FOR MULTIFAMILY, THE DEVELOPER WOULD TAKE THE SUM TOTAL OF THOSE FUNDS THAT WOULD BE ANTICIPATED TO BE COLLECTED FROM THE PROJECT AND INVEST THEM IN CONSTRUCTION OF IMPROVEMENTS AT THE PARK.

SO WHAT YOU CAN SEE HERE ON THIS CONCEPT PLAN THAT THE DEVELOPER HAS PROVIDED IS A LIST OF THE BASE BID AMENITIES AND THE ALTERNATIVE BID AMENITIES.

AT THIS TIME, WE DO NOT KNOW HOW FAR DOWN THAT LIST OF ALTERNATE BID AMENITIES WE WOULD BE ABLE TO INCLUDE IN THE APPROXIMATELY $1.9 MILLION THAT IS THE TOTAL VALUE OF THE PARK DEVELOPMENT FEES.

BUT THE $1.9 MILLION WOULD BE USED TO FUND, DESIGN, AND CONSTRUCTION OF THE BASE BID AMENITIES PLUS DESIGN OF THE ALTERNATE BID AMENITIES AND CONSTRUCTION OF ANY OF THOSE THAT WOULD FIT WITHIN THE BUDGET.

THE WAY THE AGREEMENT IS CURRENTLY DRAFTED, IT WOULD ALLOW FOR THE PARK BOARD TO WORK WITH THE DEVELOPER TO FINALIZE THE LIST OF AMENITIES.

AND THEN THE DEVELOPER WOULD DESIGN THE PROJECT IN ITS ENTIRETY.

GO OUT TO BID PRIVATELY, AND THEN SELECT THEIR TEAM THAT WOULD COME IN AND CONSTRUCT THOSE IMPROVEMENTS ON THE CITY'S PARKLAND.

THEN THERE ARE SPECIFIC TIMELINES WRITTEN INTO THE AGREEMENT FOR THE DEVELOPER TO HAVE AMENITIES IN PLACE BEFORE A CERTAIN NUMBER OF HOMES BEING OCCUPIED.

SO IT'S SPLIT INTO TWO DIFFERENT SECTIONS ON THAT PORTION OF THE AGREEMENT.
